Purpose Statement A. The Board recognizes that school health services, screenings, and examinations may support student well-being and may help identify health conditions that could interfere with a student’s ability to access or benefit from school. The District shall provide such services only as authorized by law, Board policy, and applicable parent/guardian consent requirements. 2. Annual Notice of Health Services A. At the beginning of each school year, the Superintendent/designee shall notify parents/guardians of the health services offered or made available through the District. The notice shall also identify health services offered on school property or as part of a school program by private organizations partnering with the District. B. The school principal/designee shall notify parents/guardians of any new health services that become available after the annual District notice has been provided. C. Health services may include, but are not limited to: i. Consultation services of a qualified specialist for staff, students, or parents/guardians; ii. Vision and hearing screenings; iii. Immunization-related services or information as provided by applicable law or public health authority; and iv. Other health services, screenings, or examinations authorized by law and District policy. 3. Parent/Guardian Consent A. The District shall not furnish health care services or solicit to furnish health care services to a student without parent/guardian consent or court order, except as otherwise authorized by law, including nonemergency first aid or a medical emergency. B. Consent for health care services is optional and may be given on a case -by- case basis unless otherwise required by law. No parent/guardian shall be STUDENTS 3500 Bonneville Joint School District No. 93 Health Screenings required or pressured to provide blanket consent as a condition of enrollment or participation in a school-sponsored activity. C. A parent/guardian may revoke consent for any further health care service at any time. D. If a parent/guardian declines to consent to a health care service, the staff member responsible for seeking consent shall document the effort to contact the parent/guardian and the parent/guardian’s refusal or failure to respond, as applicable. 4. Screening Results and Parent/Guardian Notification A. Parents/guardians shall receive written notice of any screening result that indicates a condition that might interfere or tend to interfere with a student’s educational progress. B. If a District staff member becomes aware of a change in a student’s mental, emotional, or physical health or well-being, the staff member shall address the matter consistent with District policy and applicable law regarding parent/guardian notification. 5. Nonemergency Invasive Physical Examinations or Screenings A. The District does not conduct nonemergency invasive physical examinations or screenings as part of its ordinary school health services. Routine school health services, such as vision, hearing, or scoliosis screenings, are not considered invasive physical examinations. B. An invasive physical examination or screening may not be administered, scheduled, required, or arranged by any District employee except in extraordinary circumstances where the Superintendent determines that the examination or screening is legally authorized, necessary to address a specific and substantial health or safety concern, and cannot reasonably be addressed through less intrusive means. C. Before any nonemergency invasive physical examination or screening is administered, scheduled, required, or arranged by the District, the following approvals and safeguards are required: i. Authorization by the Superintendent/designee; ii. Review by legal counsel; iii. Approval by the Board of Trustees at a properly noticed public meeting, except to the extent confidential student information or legal advice must be discussed in executive session as authorized by law; STUDENTS 3500 Bonneville Joint School District No. 93 Health Screenings iv. Prior written notice to parents/guardians describing the nature, purpose, provider, and specific or approximate date of the examination or screening; v. Written parent/guardian consent for the student to participate, unless otherwise authorized by court order or applicable law; and vi. An opportunity for the parent/guardian to decline or withdraw consent without penalty, unless the examination or screening is specifically required by law. D. For purposes of this policy, “invasive physical examination” means any medical examination that involves the exposure of private body parts or any act during the examination that includes incision, insertion, or injection into the body. The term does not include hearing, vision, or scoliosis screenings. E. Nothing in this section limits the District’s ability to provide or obtain emergency medical assistance when necessary to protect the immediate health or safety of a student or others. Emergency care shall be handled consistent with District policy 3540 Emergency Treatment. 6. Annual Policy Notice A. Parents/guardians shall be notified of the requirements of this policy at least annually at the beginning of the school year and within a reasonable period of time after any substantive change to the policy. 7. Definitions A. Health care service has the meaning provided in District Policy 3540 and applicable Idaho law. The term generally includes a service for the diagnosis, screening, examination, prevention, treatment, cure, care, or relief of a physical or mental health condition. B. Health screening means a limited school-based screening intended to identify a potential health concern that may interfere with a student’s educational progress or school participation. Examples may include vision, hearing, or scoliosis screenings. A health screening does not, by itself, diagnose a medical condition. C. Invasive physical examination means any medical examination that involves the exposure of private body parts or any act during the examination that includes incision, insertion, or injection into the body. Nonemergency first aid means immediate, minor care provided at school for a minor injury or illness, such as dressing minor wounds, applying topical agents, providing fluids or ice, and performing checks to identify minor illness. E. Parent/guardian means a parent, legal guardian, or other person legally authorized to make educational or health care decisions for the student. 8.
