Ammon Road Idaho Falls, ID 83401 THE CONSTRUCTION MANAGER: Headwaters Construction Company 639 W. 9500 S., Ste 1 Victor, ID 83455 ARTICLE A.1 § AAA Guaranteed Maximum Price Pursuant to Section 2.2.6 of the Agreement, the Owner and Construction Manager hereby amend the Agreement to establish a Guaranteed Maximum Price. As agreed by the Owner and Construction Manager, the Guaranteed Maximum Price is an amount that the Contract Sum shall not exceed. The Contract Sum consists of the Construction Manager's Fee plus the Cost of the Work, as that term is defined in Article 6 of this Agreement. § A.1.1.1 The Contract Sum is guaranteed by the Construction Manager not to exceed One Million Three Hundred Seventy-Four Thousand Two Hundred Forty-Nine ($ 1,374,249 ), subject to additions and deductions by Change Order as provided in the Contract Documents. § A.1.1.2 Itemized Statement of the Guaranteed Maximum Price. Provided below is an itemized statement of the Guaranteed Maximum Price organized by trade categories, allowances, contingencies, alternates, the Construction Manager's Fee, and other items that comprise the Guaranteed Maximum Price. (Provide below or reference an attachment.) Attached hereto as the "GMP No. 1 - New Bonneville High School GAP Proposal Packet Dated June 14, 2016 ". § A.1.1.3 The Guaranteed Maximum Price is based on the following alternates, if any, which are described in the Contract Documents and are hereby accepted by the Owner: (State the numbers or other identification of accepted alternates. The Proposal is presented in a ten group, systems format best utilized from analyzing and comparing project costs during design and preconstruction. This proposal is based on Headwaters Construction's incorporation of the scope shown on the Bid Package #1 documents, stamped May 18, 2016, and the scope clarifications below. Assumption, Clarifications & ExclUsions Safety • Site Visit Performed: Yes — May26, 2016 • Unique Features of Work Identified — o Interaction with neighbors on adjacent streets Quality Headwaters Construction Company has included in this estimate a high level of construction quality based on plans and specifications. Our goal is to meet and exceed client expectations. • Option Studies Performed — o Headwaters has performed Pricing Option Studies for the following: ■ Building pad construction utilizing geo -grid materials • Anticipated Mockups During Construction — o None for this bid package Schedule • Anticipated Construction Duration: 3.8 Months from Anticipated Construction Start Date (Bid Package 1) • Anticipated Construction Start Date: June 20, 2016 • Substantial Completion Date: To Be Determined in Future Bid Packages • Final Completion Date: To Be Determined in Future Bid Packages • Warranty Duration: 1 Year from the Final Completion Date Cost This Proposal does not include Prevailing Wage Rates. This proposal includes all necessary Idaho sales and use taxes. The estimated value provided in the proposal includes all direct and indirect construction costs, but does not include typical project "soft costs ". Escalation Contingency (0 %) — Escalation Contingency is not included in this Proposal. CM /GC Construction Contingency (3 1%) — CM /GC Construction Contingency is included in this proposal and is intended to be used at Headwaters Construction's discretion to cover costs that have not been completely identified as trade specific scope on the GMP setting documents, which may require further clarification or coordination. These costs include, but are not limited to, scope gap, coordination issues between trades, and missed scope during the bidding process. The CM /GC Construction Contingency is not intended to account for design revision or additional scope requests by the design / owner during construction. Owner Project Contingency (0 %) —Owner Project Contingency is not included in this Proposal. Phased GMP Due to the design schedule and the Teams overall desire to expedite the construction process the project will be designed and bid with separate GMP Amendments. The following summarizes the overall construction budget and how it relates to the separate GMP Amendments. Allowances No allowances have been included in this GMP Amendment. Subcontractors $52,885,837 All subcontractors will be properly licensed with the Idaho Division of Public Works, bidding within their license limits. All sub -tier subcontractors are also properly licensed for their respective scopes of work. Scope values are provided for transparency and as a contract schedule of values. • We anticipate normal working hours, Monday through Friday. • Headwaters Construction's proposal is for construction costs only, unless otherwise specified. Soft costs, permits and fees, inspections, etc. are expected to be covered by others. • Any and all savings or any approved value engineering savings during construction will be added to the CM /GC Construction Contingency. As the GMP Amendment 01 Proposal is lump sum, savings are not fully realized until Substantial Completion. • Any savings / remaining CMGC Construction Contingency at the end of the project will be returned to the Owner. Specific Exclusions • Typical Project "Soft Costs" unless otherwise specified. These include, but are not limited to: design professional fees, permits, and plan review fees, utility connection fees, land acquisition costs, legal fees, equipment and furnishings, special inspections, etc. • Hazardous material remediation / encapsulation (lead, asbestos, mold, etc.), except as specifically included. • "Loose" furniture, fixtures and equipment (FF &E) not specifically listed as being provided. • Third party testing and inspections • Surveying and staking Scope by Bid Package: . PACKAGE #1 WATER & SANITARY SEWER UTILITIES AND MASS GRADING Comply with the requirements of the Geotechnical Report and Contract Documents. 2. Provide dust control for all operations related to this scope of work during working hours per local authority requirements. Include all required dust control permits if required. Refer to drawings for available water sources. 3. Protect all adjacent structures, surfaces, and materials from damage during this scope of work. 4. Provide all required traffic control measures and barricades. Secure and pay for all right -of -way permits. 5. Clean and maintain trucking access routes for all equipment, including street sweeping as required for this scope of work only. 6. Keep as -built drawings current and provide weekly updates prior to approval of pay applications. 7. Provide certifications from manufacturers and governing authorities as required. Provide temporary power needed for the performance of this work. 9. Provide all excavation support and hazard protection, including shop drawings and engineering, as required (only if shoring is required). 10. Install all excavation, backfill, trenching, shoring, and temporary protection as required and in compliance with OSHA standards. 11. Clear and grub those areas identified of existing organics and stockpile on -site. Remove all refuse with haul - off and legal off -site disposal. 12. Excavate and stockpile all materials suitable for topsoil from designated areas. Stockpile locations shall be coordinated with the CMGC. Provide proper dust control at stockpiles. 11 Provide and maintain during this subcontractor's duration of work stabilized construction entrance. Entrance shall be removed in a future bid package. 14. Provide and maintain during this subcontractor's duration of work all silt fencing. Silt fencing shall be removed in a future bid package. 15. Provide and maintain during this subcontractor's duration of work all concrete wash out stations, including signage. Coordinate location with CMGC. Concrete wash out stations shall be removed in a future bid package. 16. Supply and base rock for temporary trailers and staging area (total area not to exceed 50,000 s.f.); maintain rock at these locations throughout duration this subcontractor's scope of work. Rock shall be removed in a future bid package. 17. Rough and finish grade all sub - grades for building pad, access roads and parking as currently delineated. Placement of crushed aggregate sub -base at parking and access roads shall be provided in a separate bid package. 18. Provide grading +/- 0.10 foot at all areas, unless otherwise noted. Notify CMGC of discrepancies in requirements before proceeding. 19. Import /mine, place, and compact structural fill materials as required. If Subcontractor elects to mine structural fill materials from designated on -site location, the backfill of mining operations is not to be included in this scope of work. 20. Provide certified building pad as per details. Subcontractor shall ensure that all "CL" soil materials are removed from building pad location. Provide building pad mat including all Geogrid materials and crushed aggregate fill. Provide imported /mined structural fill for 1500 psf bearing location. 21. Provide exterior backfill of foundation with approved materials. Interior backfill shall be provided by a separate bid package. 22. Supply and install all concrete /thrust blocks for this scope of work. 23. Supply and install domestic, and fire water systems including, trenching, bedding, taps, piping, fittings, valves, hydrants, compacted backfill, and all related components required for a complete system. 24. This Subcontractor shall sub - subcontract with a qualified Public Work's licensed plumbing subcontractor to install all under -slab waste and drain lines as shown. Provide all necessary permits. Provide all necessary permits. 26. Supply and install sewer system including piping, fittings, clean -outs, manholes, and tie -ins to building sewer invert. 27. Provide all saw cutting and patching of existing surfaces as necessary at water and sewer connection points. 28. Disinfect and chlorinate water lines. 29. Provide all required testing and video camera records of systems as required. 30. Provide fabric inlet protection at newly installed and existing manholes. 31. Protect & maintain survey monuments and staking to prevent damage.
