Executive Session A. Chairman Brian McBride stated that the Board will enter into Executive Session pursuant to Idaho Code Section 74-206(1)(a) To consider hiring a public officer, employee, staff member or individual agent, wherein the respective qualities of individuals are to be evaluated to fill a particular vacancy or need; Idaho Code Section 74-206(1)(b)To consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student and Idaho Code 74-206(1)(c) To acquire an interest in real property which is not owned by a public agency. The Executive Session will be closed to the public as permitted by law. The Board entered Executive Session at 8:54 p.m. MOTION: Amy Landers made the motion to enter into executive session for the reason stated. Paul Jenkins seconded. The roll call vote was: 11. Student DisciDline— Chairman Brian McBride invited Sandcreek Middle School Principal Yvonne Thurber t0 discuss student 17-1. She informed the Board about the incident that occurred at Sandcreek on October 25, 2016 and recommended that 17-1 be expelled without a hearing and to be conditionally readmitted to Sandcreek Middle School. Discussion was from 9:01p.m.to 9:14p.m. Chairman Brian McBride invited Lincoln High School Principal Lance Miller to discuss student 17-J. He informed the board of the incident that occurred at Lincoln HS on November 1, 2016 and recommended 17-J be expelled, upon parent's waiving a hearing by accepting an expulsion without a hearing, and to be conditionally readmitted to Lincoln High School pending a risk assessment. Discussion from 9:14p.m,to 9:31 p.m. B. Land Discussion - John Pymm Chairman Brian McBride invited John Pymm to discuss land negotiations pertaining to the new high school property; the board advised Mr. Pymm to follow through on the items discussed. Discussion from 9:31 p.m.to 9:55p.m. C. Leave Without Pay Requests— Scott Woolstenhulme Scott Woolstenhulme discussed two Leave Without Pay requests. First, a full time employee requested Board of Trustees 0 Brian McBride 0 Paul Jenkins 0 Amy Landers V Jeff Bird 0 Greg Calder Bonneville Joint School District No. 93 is ar Equal Opportunity Employer LWOP to recuperate from surgery and is eligible for FMLA; second, a part time long term employee requested LWOP to have knee surgery and is not eligible for FMLA. Owner's Representative Contract — John Pymm Chairman Brian McBride invited John Pymm to discuss Owner's Representative Contract, The Board advised Mr. Pymm to renegotiate the owner's representative contract to include the upcoming elementary addition projects. Discussion from 9:55p.m.to 10:02p.m. IV. Move Back Into Open Meetino Chairman Brian McBride asked for a motion to move back into Open Meeting at 10:15 p.m. MOTION: Greg Calder made the motion to move back into open session. Paul Jenkins seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. V. Motions from Executive Session A. Student 17-1 Discipline MOTION: Amy Landers made the motion to expel 17-1 without a hearing and to be conditionally readmitted to Sandcreek Middle School for the first five periods of the day for the 2016-2017 school year. Jeff Bird seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. B. Student 17-J Discipline MOTION: Jeff Bird made the motion to expel 17-J for one year either with parent's waiving a hearing by accepting an expulsion without a hearing or requesting an expulsion hearing, and to be conditionally readmitted to Lincoln High School pending a risk assessment. Greg Calder seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. C. Property Negotiations No motion was made. D. Leave Without Pay Decisions MOTION: Paul Jenkins made the motion to approve Leave Without Pay for Brad Anderson as requested. Jeff Bird seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. MOTION: Greg Calder made the motion to approve Leave Without Pay for Jeannie Sommer as requested. Paul Jenkins seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. E. Owner's Representative Contract No motion was made. VI. Adiournment Chairman Brian McBride asked for a motion to adjourn at 10:18 p.m. MOTION: Greg Calder made the motion to adjourn. Jeff Bird seconded.
