CONTMCTUAT AGREEMENT
This AGREEMENT entered into by Bonneville Joint School District tt93, located in Bonneville County, hereinafter referred
to as the District, and NORM FUNKE dba Uoper Valley Sales. hereinafter referred to as the Contractor, is for the fiscal
year 2015-16, beginning July 1, 2015.
SERVIC€S. Contractor agrees to provide services to repair and maintain copy machines located throughout the District,
responding to copier problems in atimely manner. ln addition, Contractor will maintain a service logtracking service
calls and repair parts by building.
FEES. ln consideration for Contractor performing all obligations under this Agreement, the District agrees to pay
Contractor a monthly fee of $2,850.fi) for an annual amount of $34,200.00. ln addition, Contractor may request
payment for parts/supplies purchased to service this contract by submitting a detailed invoice to the Oistrict.
PAYMENT TERMS. The payment terms are net 30 days.
TERM AND TERMINAnON. The term of this Agreement begins on July 1, 2015 and expires June 30, 2018.
TERMINATION FOR BREACH. lf either party breaches any provision contained in this Agreement, and the breach is not
cured within thirty (30) days after the breaching party receives notices of the breach from the non-breaching party, the
non-breaching party may then deliver a second notice to the breaching party immediately terminating this Agreement.
GENERAI. This agteement is the entire agreement between the parties and supersedes allearlier and simultaneous
agreements regardinB the subject matter, includinS, without limitation, any invoices, business forms, purchase orders,
proposals or quotations.
BUILDING ACCESS. ln accordance with ldaho Code 33-130 and District policy, Contractor agrees to be fingerprinted and
haveacriminal background check. lf the resu lts of the backgrou nd check dete rmine th e Contractor is ineligible to work
in a public school setting, this Agreeme nt will be null andvoid. The Contractor will be given access to those facilities
with copy machines that need serviced under this contract. Access to school facilities is for business purposes only and
Contractor agrees to follow all District rules and policies regarding building access.
Contractor agrees that as an independent contractor, he is not eligible for district benefits of any kind. Contractor
agrees to maintain liability insurance in the minimum amount of S1,000,000 and worke/s compensation coverage.
Contractor will provide the District with a completed IRS form W-9.
