The Bonneville Joint School District No. 93 Board of Trustees may deny enrollment or
attendance to any student at any of its schools by expulsion if the student:
Js an habitual truant;
)is incorrigible;
)has been expelled from another school district in this state or any other state;
or if the student's:
)exhibits conduct, in the judgment of the Board, is such as to be continually
disruptive of school discipline or of the instructional effectiveness of the school;
)presence in a public school is detrimental to the health, or safety of other
students;
)parent/guardian fails to furnish or to request accurate copies of school records
including information concerning violent or disruptive behavior or disciplinary
action involving the student from the out -of -district school from which the
student is transferring;
)parent/guardian fails to furnish current immunization records or a valid
immunization exemption form at the time of first admission.
Guidelines
1. Only the Board has the authority to deny enrollment or expel a student from school.
2. No student shall be expelled or denied enrollment without the Board of Trustees
having first given written notice to his/her parent/guardian stating the grounds for the
proposed expulsion or denial of enrollment and the time and place where such
parent/guardian may appear to contest the action of the Board.
3. The Board will grant any student a full and fair hearing regarding a recommendation
for expulsion or denial of enrollment.
4. Students shall not be expelled for behavior reasons unless other forms of corrective
action or punishment have failed, or unless there is good reason to believe that other
forms of corrective action or punishment would fail if employed.
Admission to School Premises or Activities
1. Any student who is expelled from attendance at Bonneville Joint School District No.
93 is prohibited admission to any school premises or to any school sponsored
activity, regardless of location.
2. If a student violates an expulsion order by entering school property or by attending
school functions without permission, the District may refer the matter to the local law
enforcement agency.

Readmission
1. Any student having been denied enrollment or expelled may be enrolled or be
readmitted to school upon such reasonable conditions as may be prescribed by the
Board.
2. Such enrollment or readmission will not prevent the Board from subsequently
expelling such student for cause.
Notice to the Prosecuting Attorney
1. Any student within the age of compulsory attendance, who is expelled or denied
enrollment will come under the purview of the Juvenile Corrections Act.
2. An authorized representative of the Board shall provide written notice of such to the
prosecuting attorney of the county of the student's residence.
Weapons Violations
As set forth in Board Policy #3335 Prohibition of Weanons, the Board will expel from
school any student who has been found to have carried a dangerous weapon or firearm
on school property.
Students with Disabilities
A student with disabilities will be expelled or denied attendance pursuant to the
requirements of federal law Part B of the Individuals with Disabilities Education Act
(IDEA) and Section 504 of the Rehabilitation Act as well as the provisions of this policy.
DEFINITIONS
Age of Compulsory Attendance: ages seven (7) through sixteen (16).
Expulsion: the removal or exclusion of a student from the immediate supervision and
control of school. Only the Board has the authority to expel or deny enrollment to any
student.
Habitual Truant: any pupil with two (2) truancies in a grading period or four (4)
truancies over the three (3) years of grades seventh through ninth (7-9) or tenth through
twelfth (10-12); or any child whose parents/guardians, has failed or refused to cause
such child to be instructed as provided in Idaho Code 33-202.
To any school premises or to any school sponsored activity, regardless of
location: shall include, but not be limited to buildings, facilities, and grounds on the
school campus, school busses, school parking areas; and the location of any school

sponsored activity. This includes instances in which the conduct occurs off the school
premises but impacts a school related activity.
