CRIMINAL HISTORY – BACKGROUND CHECKS
It is the policy of Bonneville Joint School District No. 93 to perform Criminal History
Checks pursuant to Idaho Code section 33-130 and to perform other types of
background checks on employees, volunteers, or contractors including, but not limited
to:
1. Contacting prior employers for references and past performance
records;
2. Contacting personal references;
3. Contacting other persons who, in the discretion of the District, could
provide valuable information to the District; and/or
4. Searching the Idaho State Police Sex Offender Registry.
The Board of Trustees will not employ any applicant or continue the employment of any
employee who is deemed unsuited for service by reason of arrest and/or conviction of a
felony offense pursuant to Idaho Code section 33-1208(2).
Guidelines
Requirement for Criminal History Checks
1. In order to protect the health, safety, and welfare of students in the District, the
following individuals will be required to submit to Criminal History Checks. The list
includes, but is not limited to:
a. Certificated and non-certificated employees;
b. All applicants for certificates:
c. Substitute teachers;
d. Individuals involved in student training such as student teachers, internships, and
practicums;
e. Volunteers who have unsupervised contact with students;
f. Private Service providers and consultants; and
g. Any other individuals who may have unsupervised contact with students.
2. Criminal History Checks shall be submitted prior to starting employment.
3. The District may require any of its employees to be subjected to Criminal History
Checks.
4. Additional Criminal History Checks shall be required whenever there is a “break in
service”, however short (Idaho Department of Education, Back -ground Investigation
Check Handbook).

Substitute Teachers
Substitute teachers are required to undergo a Criminal History Check every five (5)
years and to pay the cost of such.
Coaching Staff
Any coaching staff who is not a permanent employee of the District shall be required to
undergo a Criminal History Check every five (5) years.
Volunteers
1. Any volunteer in the District who has regular unsupervised access to students, as
determined by the principal shall submit to a Criminal History Check prior to
volunteering in the school.
2. The principal along with input from the athletic director may require a ny volunteer to
submit to a Criminal History Check prior to working with student athletes.
3. Any requirement of a volunteer to submit to a Criminal History Check shall be in
compliance with the Volunteers for Children Act of 1998 and applicable federal
regulations.
Misrepresentations or Omissions
If an applicant, employee, or volunteer makes any misrepresentation or willful omission
of fact regarding prior criminal history, such shall be sufficient cause for disqualification
or termination.
Reporting Arrests or Convictions
All employees shall have the continuing duty to notify supervisors or principals of any
arrest, criminal conviction, or protection order served (minor traffic infractions excluded)
that occur while employed by the District pursuant to policy #5021 Employee Duty to
Report Arrests or Criminal Convictions.
Contractors
The District shall cross-check all contractors or other persons who have irregular
contact with students against the Idaho State Police Sex Offender Registry.
Confidentiality
1. Employees who have access to information regarding Criminal History Checks shall
ensure that such remain confidential.

2. If an employee discloses such information without authorization, the employee shall
be subject to disciplinary action.
DEFINITION:
Permanent Employee: any employee who receives a monthly paycheck from the
District.
