Contractual Agreement w ith Panorama Green
TH IS AGREE M ENT entered in t o on June 24, 2020 b etween Bo nn evi lle Schoo l Distri ct #93, hereby known
as the District, hav ing a principa l place of busin ess at 3497 N. Am mon Ro ad , Idaho Falls, Idaho, and
Panorama Green , hereby known as t he Contra ctor, is for the school year 2020-21.
The fo llow in g service(s) requested: School Psychology Online Services, Asses sments, File Reviews, and
Eligibi lity Reviews
Dates of service: begin n in g August 1, 2020 thr ough June 30, 2021
Hours of servi ce: at the maximum of 40 hours per w eek at t he rate of$ 47.00 p er hour
Contrac t or requirements attached hereto are made a part of this contract.
The parties agree that the Co nt r actor is so l ely respon sib le for all co st s and ex pense s i ncurred i n
connectio n w ith th e performance of those services desc ribed in t his agreement unless not ed abo ve.
1. The Cont ractor agrees to provide sc hool ps yc hology a nd related serv ice s in acc ordance with the
ru les and reg ulation s estab li shed by the Idaho State Board of Educati o n as provi ded in Sec tion
33 -3003 , Idaho Code , as amended for exceptional studen t s liv in g i n this district.
2. Th e Co ntractor agree s to prov ide education and / or related se rvic es fo r ide ntified st u dent(s)
incl ud ing:
a. Th e appropriat e staff an d oversig ht to imp lement IEP s for each st udent as determined
by t he sc hool IEP team;
b. Services to t he students according to the schoo l district's 2020 -21 sc hool calend ar
(attached), excluding em ergency scho o l clo sures or w hen a student is ab se nt.
3. The Contractor further agrees t o prov id e th e Di strict the follow i ng :
a. Services as au th orized in th e st udent 's I EP /504;
b. Other services such as cons u lt ation s and meet ings;
c. Assurance that all w ork w i ll be performed in ac cordance w ith t he highest professional
standards;
d. A copy of t he serv ice provider's Staff Qualification s showing profes sional credenti als for
the district's file s;
e. Verification all emp loyees w ho come into co ntact w ith th e student ha ve been su bj ect to
a crimina l ba ckground check as requi re d by Idaho Co d e 3 3-130 and ha v e been
determined to not ha ve a crimina l history inconsist ent w ith w orking with chi ldren .
f . Dai ly comp let ion of the Di strict 's repo rt as a mean s of writ ten documentat io n fo r se rvi ce
days, times and resu lt s of services provided fo r each student, as pe r the IEP.
g. Submission of bill i ng to Special Se rvices for services provided withi n 30 days of t he
date of the service provi ded . Additi onal hours will be compe nsated at the sam e rate,

provided that the additional hours, over and above those stated, have received prior
written approval of the Director of Special Services. All invoices should be numbered
and dated showing the dates and hours of service provided for each student.
h. Certificate of Liability Insurance .
i. Proof of Worker's Compensation coverage.
4. If the student is no longer receiving services from the Contractor for any reason, the Contractor
sha ll inform the District, and the obligation of the District to pay for services will cease as of the
last day of service provided.
S. The Contractor and the District agree to comply with all pertinent statues of the State of Idaho
and such rules and regulations as the State Board of Education may legally prescribe, which are
by reference incorporated in and made a part of this Contract as though set forth herein.
6 . The District assures that health-related services or program placement will begin after having
conducted an IEP team meeting to develop an IEP . The Contractor, at the District's discretion,
may request or attend subsequent IEP team meetings to revise the student's IDP, but a District
representative must participate in all such meetings.
7 . The District will pay the Contractor based on submis sion of an invoice with documentation as
described in 3.g .
8 . The District will provide documentation necessary for the Contractor to carry out the portion of
the IEP that falls under Contractor responsibility.
9. The District may terminate this Agreement immediately if the District determines that the
Contractor has willfu ll y violated any statutory requirement or government regulation or the
services related to this Agreement are modified or terminated for a student. Either party may
terminate this Agreement without ca use upon providing 30 days written notice to the other
party.
10. Contractor shall be solely liable for any losses or damages resulting from performance of any of
the servi ces covered by this Agreement. Contractor sha ll indemnify and hold harmless the
District from any liability, including, but not limited to, cost, expenses, and attorney fees,
resu lting from Contractor's performance of the services provided under this Agreement. Proof
of liability insurance with Bonneville School Di strict #93 listed as an "additional in sured" shall be
submitted to the Di strict within ten (10) day s of the date of this Ag reement.
The Contractor agrees that as an independent contractor it is not eligible for district benefits of any kind .
The Cont ra ctor also agrees to maintain liability insurance in the minimum amount of $1 ,000,000.00 and
worker's compensation coverage for its employees. If the contractor does not ha ve worker's
compensation , they will pay$ .SS for every$ 100 billed. This will be deducted in the invoi ce .
