W hereas, Id aho Co de #33-2004 sets forth provisions w hereby schoo l distr icts may provide FAPE t o spec ia l ed u catio n stud ents through a co ntract wit h contractor a pp rove d by t he Ida ho St at e De partment of Edu cation (SOE), TH IS AGREE MEN T IS EN TERED into on July 28, 2020 between Bonneville Schoo l District #93 , here by known as t he Dis t rict, having a principa l place of business at 3497 N. Ammon Road, Idaho Falls, Ida ho, and Riverside Service Group, hereby known as the Contractor. Through this agreement, the Co ntract or ag rees t o provide th e following program and/or service . The followin g se rvice(s) r equ ested: Bl Paraprofessional Services, Behavioral Intervention Specialist/Community Based Rehabilitation Services (CBRS) Services, Habilitative Technician, and Personal Care Services (PCS) Dates of serv ice: begi nning Augu st 1, 20 20 through June 30, 2021 Ho urs of serv ice: Bl Professional (Masters) at the rate of $46.00 per hour. Bl Paraprofessional/PCS at the rate of$ 18.33 per hour. Behavioral Inte rvention Sp ecialist/PSR at the rate of $35 .15 per hour. Habilitative Technician at the rate of $29 .61 per hour. Co ntractor req u irements attached her eto are made a part of this contract. The parties agree t h at t he Contractor is solely responsible for all costs and expenses incurred i n co nnect ion with the performance of those services described in this agreement unless not ed above. 1. The Contract o r agrees t o provide specia l education and/or r e lat ed serv ices in accordance w ith th e foll owing st ate and f ede ra l laws an d r eg ul ati ons: Ida ho Code; Id ah o State Board of Educa t ion Reg ulatio ns pertai nin g to special ed ucation; th e Individ ua ls w ith Disabi li t ies Educa tion Act; Part 34 of t he Code of Federa l Regu lations Sections 300.300-300.349 and 300.400-300.56; Section 504 of t he Re habilitation Act; Part 104 of the Code of Federal Reg u lations; and t he Fam ily Educatio nal Rights and Privacy Act. These reg ulations include, but are not limited t o, pr ovisi o ns re lat ing to: a. FAPE b . Least Rest ri ctive Environment (LRE) c. Perso n nel wh o meet appropr iate standards d. Individu al ize d Education Programs (IEPs) e. Parent pa rticip ation Bonnevill e Jt. Confidentiality of information i. Nondiscrimination on the basis of handicap 2. The Contractor agrees to provide education and/or related services for identified student(s) including: a. The appropriate staff and oversight to implement IEPs for each student as determined by th e school IEP team; b. Servi ces to the student according to the school d istrict's 2020-21 school calendar (attached), excluding emergency school closures or when a student is ab sent. 3. The Contractor further agree s to provide the Dis trict the following : a. Se rvices as authorized in the student's IEP ; b. Ass urance that all work will be performed in accordance with the highest professional standards; c. Ongoing progress reports used to monitor each student's progress toward IEP goal s and objectives; d. A copy of the service provi der's Staff Qualifications showing profess ional credential s for the district's files; e. Verification the contractor personnel re sponsible for providing special education and related services meet the highest entry-level state standards for the appropriate occupation category; f . Daily completion of the Di strict's report as a means of w r itten documentation for service days, times and re sults of services provided for each student, as per the IEP. g. Verification all employees who come into contact with the student have been subject to a criminal background check as required by Idaho Code 33-130 and have been determined to not have a criminal history inconsistent with wo r king with children . h. Submission of billing to the Director of Federal Programs for services provided within 30 days of the date of the service provided. Additional hours will be compensated at the same rate, provided that the additional hours, over and above those stated, have received prior written approval of the Director of Federal Programs. All invoices should be numbered and dated showing the dates and hours of service provided for each student. i. Proof of Worker's Compensation coverage. 4. If the stud ent is no longe r r eceiving services from the Contractor for any reason , th e Contractor shall inform the Di strict, and the obligation of the District to pay for service s will cease as of the la st day of service provided . 5. The Contra ctor and the Di strict agree to comply with all pertinent statu es of the State of Idaho and such rules and regulations as the State Board of Education may legally presc ribe, which are by reference i ncorporated in and made a part of this Contract as though set forth herein . 6. The District assur es that health-relate d se rvices or program placement will begin after having condu cted an IEP team meeting to develop an IEP . Th e Contractor, at the District's discretion, may request or atte nd sub sequent IEP team meetings to rev i se the student's IDP, but a Di strict repre sentative must participate in all such meetings. The District will pay the Contractor based on submission of an invoice with documentation as described in 3 .h. 8. The District will provide documentation necessary for the Contractor to carry out the portion of the IEP that fall s under Contractor responsibility. 9. The District may terminate this Agreem ent immediately if the District determines that the Contractor ha s willfully violated any statutory requirement or government regulation or the services related to this Agreement are modified or terminated for a student. Either party may terminate this Agreement without cause upon providing 30 days written notice to the other party. 10. Contractor shall be solely liable for any lo ss es or damages resulting from performance of any of the services covered by this Agreement . Contractor shall indemnify and hold harmless the Di strict from any liability, including, but not limited to, cost, expenses , and attorney fee s, re sulting from Contractor's performance of the se rvices provided under this Agreement. Proof of liability insurance with Bonne ville School District #93 listed as an "a dditional insured" shall be submitted to the District within ten (10) days of the date of this Agreement . Riverside Service Group agrees that as an independent contractor it is not el igible for district benefits of any kind. Riverside Service Group also agrees to maintain liability in surance in the minimum amount of $1,000,000.00 and worker's compensation coverage for its employees.
