STUDENTS <br />ASSAULT AND /OR BATTERY <br />3315 <br />(also 4380, 5252) <br />Page 1 of 2 <br />Any assault and /or battery on any individual, where the assault and /or battery occurs on <br />any school premises or at any school sponsored activity, regardless of location, is <br />prohibited. <br />Guidelines <br />1. Discipline for an employee, may involve actions up to and including dismissal. <br />2. Discipline for a visitor, may involve actions up to and including future prohibition from <br />entering any school premises or attending any school sponsored activity, regardless <br />of location. <br />3. Discipline for a student, may involve actions up to and including suspension, and /or <br />expulsion. <br />4. Discipline shall be appropriate to the offense, age and status of the individual. <br />5. The Su perintendent/designee shall submit the case to the appropriate law <br />enforcement agency when the charges warrant such action. <br />DEFINITIONS <br />Assault: any willful attempt or threat to inflict injury upon another person, when coupled <br />with an apparent ability to do so, and any intentional display of force such as would give <br />the individual reason to fear or expect immediate bodily harm. An assault may be <br />committed without actually touching, or striking, or doing bodily harm to another person. <br />Battery: any unlawful touching of another person which is without justification or <br />excuse. <br />On any school premises or at any school sponsored activity, regardless of <br />location: shall include, but not be limited to buildings, facilities, and grounds on the <br />school campus, school busses, school parking areas; and the location of any school <br />sponsored activity.
