HomeMy WebLinkAbout4320 Disruptive Employee or Public ConductCOMMUNITY RELATIONS 4320 (also 5245) Page 1 of 2 DISRUPTION OF THE EDUCATIONAL PROCESS The Bonneville Joint School District No. 93 Board of Trustees has the power and duty to prohibit entrance, to prohibit loitering, and to provide for the removal from any District premises or any school sponsored activity, regardless of location, of any individual or individuals who disrupt the educational processes or whose presence is detrimental to the morals, health, safety, academic learning, or discipline of the students or other individuals. Guidelines 1. The Board authorizes the principal /designee or site administrator to determine whether the conduct of an employee or visitor is disruptive to the educational program. 2. The principal /designee or site administrator is authorized to take immediate action necessary to prevent the disruptive conduct and /or remove the disruptive individual from school property, including, but not limited to seeking assistance from local law enforcement. 3. If the offender is an employee, the Superintendent /designee shall determine appropriate disciplinary actions up to and including dismissal. 4. If the offender is a visitor, discipline may involve actions up to and including future prohibition from entering any school premises or attending any school sponsored activity, regardless of location. 5. The Superintendent /designee shall submit the case to the appropriate law enforcement agency when the circumstances warrant such action. 6. Pursuant to Idaho Code §18 -916, anyone who upbraids, insults, or abuses a teacher in the presence and hearing of students is guilty of a misdemeanor. DEFINITIONS Disruptive conduct: includes, but is not limited to: • any conduct intended to, or having the effect of, obstructing, disrupting, or interfering with teaching, service, administrative disciplinary functions, or any school sponsored activity; physical abuse or threat of harm to any person; sexual harassment of any person; Bonneville Joint School District No. 93 COMMUNITY RELATIONS 4320 (also 5245) Page 2 of 2 forceful or unauthorized entry to or occupation of school facilities or the facilities of a school authorized activity; and any verbal assault or other gesture that inflicts emotional or social harm. On any school premises or at any school sponsored activity, regardless of location: shall include, but not be limited to buildings, facilities, and grounds on the school campus, school busses, school parking areas; and the location of any school sponsored activity. This includes instances in which the conduct occurs off the school premises but impacts a school related activity.
