HomeMy WebLinkAbout5220 Certified Personnel ResignationsPERSONNEL CERTIFIED PERSONNEL RESIGNATION RELEASE FROM CONTRACT 5220 Page 1 of 2 Applicants for certified positions with Bonneville Joint School District No. 93 who are issued a contract and employees who are currently under contract should recognize that their agreement with the District carries responsibilities. Guidelines 1. Certified personnel will generally be expected to fulfill the terms of their contract unless: a. there are clearly compelling and /or mitigating circumstances which prevent the individual from doing so; and b. the Board releases the employee from the terms of their contract upon the recommendation of the Superintendent /designee. 2. Employees, including those who have signed an initial contract, will not be released from their agreement during the school year or after the first day of July (July 1) unless a suitable replacement can be found to fill the position being vacated. The Board may make exceptions to this rule for serious health problems or other extenuating circumstances. 3. Should a certified employee desire release from his /her contract after the first day of July or during the school year, the Board of Trustees may at its discretion request a hearing before the Professional Standards Commission, alleging that the certificated employee is guilty of unethical and unprofessional practice. 4. A written request, including the proposed date for release from contract, should be submitted to the immediate supervisor and a copy submitted to the Human Resources Department. a. Upon receipt of the request, a search for a suitable replacement may be initiated and the resignation transmitted to the Board at the time specified. b. If no time is specified, the request will be presented when the administration feels that finding a suitable replacement is imminent. c. The person making the request will be advised of that action by the immediate supervisor and /or Human Resources Department. 5. A determination of availability of a suitable replacement will be made by the administration before recommending that the Board accept the request for release from contract. If a suitable replacement is not available, the immediate supervisor and /or the Assistant Superintendent will advise the employee that denial of the request will be recommended to the Board. b. The employee will have the opportunity to hold the request until a suitable replacement can be found, at which time the resignation will be submitted to the Board with a recommendation to accept.
