PERSONNEL <br />CERTIFIED PERSONNEL RESIGNATION <br />RELEASE FROM CONTRACT <br />5220 <br />Page 1 of 2 <br />Applicants for certified positions with Bonneville Joint School District No. 93 who are <br />issued a contract and employees who are currently under contract should recognize <br />that their agreement with the District carries responsibilities. <br />Guidelines <br />1. Certified personnel will generally be expected to fulfill the terms of their contract <br />unless: <br />a. there are clearly compelling and /or mitigating circumstances which prevent the <br />individual from doing so; and <br />b. the Board releases the employee from the terms of their contract upon the <br />recommendation of the Superintendent /designee. <br />2. Employees, including those who have signed an initial contract, will not be released <br />from their agreement during the school year or after the first day of July (July 1) <br />unless a suitable replacement can be found to fill the position being vacated. The <br />Board may make exceptions to this rule for serious health problems or other <br />extenuating circumstances. <br />3. Should a certified employee desire release from his /her contract after the first day of <br />July or during the school year, the Board of Trustees may at its discretion request a <br />hearing before the Professional Standards Commission, alleging that the certificated <br />employee is guilty of unethical and unprofessional practice. <br />4. A written request, including the proposed date for release from contract, should be <br />submitted to the immediate supervisor and a copy submitted to the Human <br />Resources Department. <br />a. Upon receipt of the request, a search for a suitable replacement may be initiated <br />and the resignation transmitted to the Board at the time specified. <br />b. If no time is specified, the request will be presented when the administration feels <br />that finding a suitable replacement is imminent. <br />c. The person making the request will be advised of that action by the immediate <br />supervisor and /or Human Resources Department. <br />5. A determination of availability of a suitable replacement will be made by the <br />administration before recommending that the Board accept the request for release <br />from contract. <br />Bonneville Joint School District No. 93 <br />
