Call to Order Chairman Brian McBride called the meeting to order at 5:02 p.m. II. Roll Call Brian McBride present Paul Jenkins present Amy Landers present Jeff Bird present Greg Calder present III. Executive Session A. Chairman McBride stated the Board will enter into Executive Session pursuant to Idaho Code Section 74- 206(1)(b)To consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student and Idaho Code 74-206(1)(c) To acquire an interest in real property which is not owned by a public agency. The Executive Session will be closed to the public as permitted by law. The Board entered Executive Session at 5:03 p.m. MOTION: Paul Jenkins made the motion to enter into executive session for the reasons stated. Jeff Bird seconded. The roll call vote was: IV. Student 17-J Discussion from 5:03p.m.to 6:13p.m, Chairman Brian McBride turned the hearing over to Attorney Doug R. Nelson, the duly appointed hearing officer for the purposes of administering the hearing. Mr. Nelson stated that his role as a hearing officer is to conduct the hearing in a way that the Board can hear all the information from the administration, the family, their counsel, and the student regarding the incidents involved and the situation so they can make an informed and appropriate decision for the benefit of the family and the school because both interests are important. The student will be known as 17-J for their protection and privacy, The proceedings will not be discussed outside this room by the administration or the Board. Mr. Nelson stated that the hearing is being recorded so that the administration or the family will be able to refer to it later if needed, A packet of all records that have come to the Board's attention relating to this incident were given to the student's family. Property Discussion - John Pymm Discussion from 6:21 p.m.to 7:03p.m. Mr, Pymm sought advice from Mr. Doug Nelson about the property line disputes near new high school construction site. Mr. Nelson stated that current boundaries are assumed by acquiescence of present-day owners and at time of purchase was not surveyed. He counseled the district that in any Metes and Bound land purchases, an ALTA (American Land Title Association) land survey should be done prior to purchase. The board advised Mr. Pymm to counsel with Mr.. Nelson in the property line dispute and legalities as necessary to reach a settlement. Discussion also included the vacant lots near Mountain Valley Elementary school. Mr. Pymm stated that the five lots have been appraised at $34,000 each. The board advised Mr. Pymm to proceed with the sale of the Mountain Valley lots. Mr. Pymm also stated that the sale of the proposed lot for the LDS Seminary building will be received as a sealed bid. VII, Move Back Into Ogen Meetina Chairman McBride asked for a motion to move back into open session at 7:03 p.m. MOTION: Amy Landers made the motion to move back into open session. Paul Jenkins seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. Vlll. Motions from Executive Session A. Discipline Student 17-J MOTION: Jeff Bird made the motion that the District expel student 17-J from attendance at Bonneville Joint School District No. 93, subject to the privilege to apply for conditional readmission to enroll in Bonneville Online High School for the remainder of the current school year, to work on his studies away from school property, and with the privilege to apply for conditional readmission to enroll at Lincoln High School for the 2017-2018 school year subject toterms and conditions agreed upon between the student and the District's administration. Greg Calder seconded, The vote was 5 in favor with 0 opposed and 0 abstentions. Motion was carried. B. Property Decision There was not any motion made on this item. IX. Adiournment Chairman McBride asked for a motion to adjourn at 7:06 p.m. MOTION: Paul Jenkins made the motion to adjourn. Jeff Bird seconded. The vote was 5 in favor with 0 opposed and 0 abstentions.
