STUDENTS <br />3335 <br />Page 2 of 4 <br />Expulsion of Students <br />Pursuant to the Gun -Free Schools Act, any student who is found to have carried a <br />dangerous weapon or firearm on school property shall be expelled for a period of <br />not less than one (1) year (twelve (12) calendar months) (see policy #3360 Student <br />Expulsion — Denial of Enrollment). <br />2. The Board may modify the expulsion order pursuant to the Gun -Free Schools Act on <br />a case -by -case basis, taking into account the individual circumstances and the <br />severity of the incident. <br />3. The Board may expel a student as circumstances warrant regardless of whether the <br />item at issue falls within the definition of weapon under the Gun -Free Schools Act. <br />Referral to Law Enforcement <br />1. All students expelled for bringing a firearm, weapon, or dangerous weapon to <br />school shall be referred to the criminal justice or juvenile system. <br />2. The Board, at its discretion, may refer any student who violates this policy to law <br />enforcement. <br />Denial of Enrollment <br />Bonneville Joint School District No. 93 will not admit any student who has been <br />expelled from another school district for violation of federal law, as set forth in the <br />Gun -Free Schools Act and Idaho law, regarding the prohibition of weapons until <br />said expulsion period has expired. <br />2. Timing shall be based on written confirmation from the district that initially expelled <br />the student. <br />3. If the student wishes to challenge denial of enrollment, he /she is entitled to a due <br />process hearing (see policy #3360 Student Expulsion — Denial of Enrollment). <br />DEFINITIONS: <br />Dangerous Object: anything that, although not specifically designed to hurt someone, <br />is used to cause injury or to put someone in fear. <br />Dangerous Weapon: a weapon, device, instrument, material, or substance, animate or <br />inanimate, that is used for, or is readily capable of causing death or serious bodily <br />injury, except that such term does not include a pocket knife with a blade of less than <br />Bonneville Joint School District No. 93 <br />Prohibition of Weapons <br />
