HomeMy WebLinkAbout3370 Searches and SeizureSTUDENTS SEARCHES AND SEIZURE 3370 Page 1 of 2 To maintain order and security in the schools, school personnel are authorized by the Board of Trustees of the Bonneville Joint School District No. 93 to conduct reasonable searches of school property and equipment, as well as of students and their personal effects. Guidelines School Property and Equipment and Personal Effects Left There by Students 1. School authorities may inspect and search school property and equipment owned or controlled by the school such as lockers, desks, and parking lots (Searches and Seizure Forms #3370F1 and #3370F2), as well as personal effects left there by the student, without notice or consent of the student. 2. Student vehicles parked on school property may also be inspected and searched. 3. Building principals may require each high school student, in return for the privilege of parking on school property, to consent in writing (Searches and Seizure Form #3370F2) to school searches of his /her vehicle and personal effects therein, when reasonable suspicion of wrongdoing exists. 4. The Superintendent may request the assistance of law enforcement officials to conduct inspections and searches of lockers, desks, parking lots, and other school property and equipment for illegal drugs, weapons or other illegal or dangerous substances or material, including searches conducted through the use of specially trained dogs. Students 1. School authorities may search the student and /or the student's personal effects in the student's possession when there is reasonable ground for suspecting that the search will produce evidence the particular student has violated or is violating the law or the District's student conduct rules. 2. The search itself must be conducted in a manner that is reasonably related to its objectives and not excessively intrusive in light of the age and sex of the student and the nature of the infraction. Seizure of Property 1. If a search produces evidence that the student has violated or is violating the law or the District's policies or rules, such evidence may be seized and impounded by school authorities, and disciplinary action may be taken. Bonneville Joint School District No. 93 STUDENTS 3370 Page 2 of 2 2. When appropriate, such evidence may be transferred to law enforcement authorities. Definitions Contraband: Illegal or prohibited property, the possession of which is forbidden under school policy or illegal under state or federal law. Contraband shall consist of, but is not limited to, stolen property, pornography, alcohol, tobacco, illicit drugs and /or prescription or nonprescription drugs designed to alter the feeling or behavior of an individual, or drugs that appear to be any of the above. Reasonable Suspicion: An act of judgment by a District employee or independent contractor of an educational institution which leads to a reasonable and prudent belief that a student may be using alcohol or controlled substances. Said judgment shall be based on training in recognizing the signs and symptoms of alcohol and controlled substance use. There must be reasonable grounds to suspect that evidence will be uncovered that shows a student or students have violated or is violating either school district policy or the laws of the state of Idaho or the U.S. government.
