Call the Meeting to Order Chairperson Winchester called the meeting to order at 5:30 p.m. II. Roll Call Those Board members in attendance were Chairperson Annette Winchester, Treasurer Amy Landers, Trustee Jeff Bird, and Trustee Brian McBride. Vice- chairperson Kip Nelson arrived at 5:42 p.m. Others in attendance were Superintendent Chuck Shackett, Deputy Superintendent Marjean McConnell, Attorney Douglas Nelson, student 15H, along with mother and father, Principal Jason Lords, and Assistant Principal Thomas Kennedy III. Executive Session Chairperson Winchester stated that the Board would move into Executive Session pursuant to Idaho Code Section 67-2345 (1)(b) To consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student. The Executive Session will be closed to the public as permitted by law. She then asked for a motion to move into executive session and asked that all Board members put cell phones away during the expulsion hearing. MOTION: Amy Landers made the motion to move into executive session for the reason stated. Jeff Bird seconded. The Roll Call Vote was: Jeff Bird Yes Brian McBride Yes Amy Landers Yes Annette Winchester Yes Chairperson Winchester then turned the time over to Doug Nelson as the hearing officer. Mr. Nelson stated that his role as a hearing officer is to conduct the hearing in a ways that board can hear all the information from the administration, the family, and the student regarding the incidents involved and the situation of the student so they can make an informed and appropriate decision for the benefit of the family and the school because both interests are important. Mr. Nelson then gave a complete file of all records that have come to the Board’s attention relating to this incident along with the confidential risk assessment that was conducted to the family and stated that the student would be referred to student 15H in the record to protect confidentiality. The proceedings will not be discussed outside this room by the administration or the Board. Mr. Doug Nelson stated that the hearing is being recorded so that the administration or the family will be able to refer to it later if needed. Mr. Kip Nelson arrived at 5:42 p.m. IV. Move back into open session Chairperson Winchester asked for a motion to move back into open meeting after the hearing was completed. MOTION: Brian McBride made the motion to move back into open meeting. Kip Nelson seconded. The vote was 5 in favor with 0 opposed and 0 abstentions. The motion was carried. Chairperson Winchester then asked for a motion with regard to the expulsion hearing. MOTION: Kip Nelson made the motion to expel student 15H for 1 year as advised by Mr. Nelson and conditionally readmitted to Bonneville Online School for the remainder of this school year with the following stipulations: Student 15H will maintain a B average while attending the Online School and continue counseling during the summer. The student may then be conditionally enrolled at Bonneville High School in the fall upon evidence, prior to enrolling, of an evaluation by a qualified counselor that shows the student does not pose a. risk to self or other students. The student will also agree to execute and sign an agreement of appropriate conduct. If the student does not follow the recommendations set forth, the administration may reinstate the expulsion directive or place the student in an alternative educational environment Jeff Bird seconded. The vote was: 5 in favor with 0 opposed and 0 abstentions. The motion was carried. Chairperson Winchester then asked Superintendent Shackett to call the parents and inform them of the decision and Board Clerk Valerie Messick to send written information to the family as well as place written documentation in the student’s expulsion folder along with a copy of the surveillance cameras documentation. V. Adjournment Chairperson Winchester then asked for a motion to adjourn MOTION: Brian McBride made the motion to adjourn, Amy Landers seconded. The vote was: 5 in favor with 0 opposed and 0 abstentions. The motion was carried.
